Virginia Medical Marijuana Laws
Virginia continues to move through a complex legal phase with medical cannabis firmly legal and recreational sales still pending key reforms.
Reform efforts to set up a regulated adult-use market cleared the legislature in early 2025, but were vetoed by Governor Youngkin again in March 2025.
Proposed legislation (HB 2485 / SB 970) would allow the Virginia Cannabis Control Authority to begin issuing licenses starting September 1, 2025, with retail sales not permitted until May 1, 2026, if signed into law.
No State Registration Required
Since July 1st 2022, Virginia medical cannabis patients no longer need to register with the state to purchase from certified dispensaries—your medical certification plus a Virginia ID (or proof of residency) is now sufficient.
Recreational Use Is Legal
Recreational (adult-use) marijuana is legal in Virginia as of 2021.
However, recreational cannabis sales in dispensaries have yet to begin. This means only medical cannabis patients are able to purchase cannabis products at dispensaries.
Cultivation Is Allowed
Medical patients and adults 21+ can grow up to 4 marijuana plants per household (not per person) for personal use.

Certified medical cannabis patients in Virginia are allowed to possess up to a 90-day supply of medical cannabis products, as determined by their provider. Each individual dose may contain up to 10 mg of THC.
For botanical cannabis (flower), patients are permitted to purchase and possess up to 4 ounces every 30 days. In contrast, non-patients (recreational users) are limited to 1 ounce of cannabis for personal possession.
Employee Protection
Employers, including public sector workers, are now protected from termination or disciplinary actions solely for off-duty medical cannabis use (as of 2024).
While Virginia law offers limited job protections for medical cannabis patients, employers can still enforce drug-free policies, especially in roles involving public safety or heavy machinery.
